Privacy Policy

of Volksuniversiteit Amsterdam in accordance with the General Data Protection Regulation

Article 1: Definitions

In this policy, the following terms shall have the following meanings:
a. Stichting Volksuniversiteit Amsterdam: formal statutory name of the organization.
b. Director-executive or board: the director-executive/board of Stichting Volksuniversiteit Amsterdam.
c. File: the collection of personal data that pertains to the categories of individuals mentioned in Article 3 of this policy.
d. Personal file: the entirety of (written) recorded information relating to an individual who is part of one of the categories mentioned in Article 3 of this policy. The files can exist in both physical and electronic parts.
e. Data subject: the person whose personal data is included in the file.
f. Personal data: any data that can be attributed to an individual person.
g. Third party: any individual who does not belong to the organization of the data controller, excluding the data subject.

Article 2: Purpose of the file

The purpose of the file is to collect and make available all necessary data for enrolling participants in a course offered by Stichting Volksuniversiteit Amsterdam, for use by the administration of Stichting Volksuniversiteit Amsterdam. The file also serves to inform participants about their course/lessons and other course activities of Stichting Volksuniversiteit Amsterdam.

Article 3: Categories of individuals included in the file

The file only contains data about participants, former participants, and individuals/companies who have indicated their interest in the course offerings of Stichting Volksuniversiteit Amsterdam.

Article 4: Included data and the method of obtaining

1. The file includes the data listed in Annex I, which is attached to this policy, for the individuals mentioned in Article 3.
2. The personal data is obtained through submission by the data subject (or with authorization from the data subject) upon enrollment in a course, lecture, or other activity of Stichting Volksuniversiteit Amsterdam
3. The annex referred to in the first paragraph is part of this policy.

Article 5: Responsibility

1. The director-executive is responsible for the management, development, and application of the file, in accordance with the provisions of this policy.
2. The director-executive oversees compliance with the implementation rules.
3. The director-executive ensures the necessary technical and organizational measures are in place to secure the file against loss, tampering, unauthorized access, modification, or disclosure.

Article 6: Functioning of the file

1. The file is exclusively used by the director-executive of Stichting Volksuniversiteit Amsterdam and the employees designated by them.
2. The data included in the file is solely used for the purposes described in Article 2 of this policy.

Article 7: Access to the file

1. Access to the file is exclusively granted within the scope of their assigned tasks to:

  • The director-executive
  • Staff members
  • Administrative staff
  • Janitors
  • System administrator

2. Access to the file can only be obtained through personally assigned access codes to the individuals mentioned in paragraph 1 of this article.
3. Specific rights are associated with these access codes regarding the processing, modification, deletion, consultation/viewing of the stored data.
4. A teacher has functional access to some personal data of the participants in the teaching activity they are involved in, namely: name, address, place of residence, telephone number, and/or email address, in order to inform them about matters related to the specific teaching activity.

Artikel 8: Provision of data to third parties

1. No data from the file will be provided to third parties unless:

  • It is required by law.
  • It is done with the consent of the data subject.
  • It is requested by public authorities with a legal task.

2. The provision of data is withheld to the extent that confidentiality is required by virtue of office, profession, or legal provision.

Article 9: Retention and destruction of data

If there has been no contact between the data subject and Stichting VOLKSUNIVERSITEIT AMSTERDAM for a period of seven years, the personal data will be destroyed. Financial registration data is linked to the personal data. Stichting VOLKSUNIVERSITEIT AMSTERDAM is required to retain financial data for a period of seven years in accordance with legal tax provisions.

Article 10: Right to access, inspection, and copy

1. The data subject or their authorized representative can approach Stichting VOLKSUNIVERSITEIT AMSTERDAM to request access to the registered data.
2. Stichting VOLKSUNIVERSITEIT AMSTERDAM provides access within 4 weeks after receiving the request.
3. The data subject (or their authorized representative) is granted access to the file regarding the data concerning the data subject. If desired, a copy of the requested data will be provided.
4. Access is granted and copies are provided only upon a request addressed to the director-executive
5. Stichting VOLKSUNIVERSITEIT AMSTERDAM requires that the identity of the requester and any authorized representative can be unequivocally established by its employees.
6. A decision to deny access is substantiated.

Article 11: Right to rectification

1. The data subject (or their authorized representative, with explicit request from the data subject) has the right to request correction, supplementation, or shielding of the data recorded in the file if they believe that the recorded data is incorrect, incomplete, irrelevant to the purpose of the file, or in violation of this policy.
2. A request for deletion can only be implemented in accordance with the provisions of Article 9.
3. The request for correction, supplementation, deletion, or shielding of personal data is submitted in writing to the director-executive of Stichting VOLKSUNIVERSITEIT AMSTERDAM.
4. The request specifies the changes to be made.
5. The decision of the director-executive on the request is communicated to the requester within 4 weeks after receiving the request.
6. Stichting VOLKSUNIVERSITEIT AMSTERDAM ensures that a decision to rectify, supplement, delete, or shield is implemented as soon as possible.
7. A decision to deny the request is substantiated.

Article 12: Appeal

1. If Stichting VOLKSUNIVERSITEIT AMSTERDAM refuses to comply with a request for access, inspection, copy, shielding, or correction, the data subject can, based on the General Data Protection Regulation, submit a written request to the District Court of Amsterdam, asking it to order Stichting VOLKSUNIVERSITEIT AMSTERDAM to comply with the request.
2. The application must be submitted within 6 weeks after receiving the rejecting decision from the data controller. If the data controller has not responded within the deadlines set out in Articles 10 and 11, the application must be submitted within 6 weeks after those deadlines.
3. The data subject can also, within the deadline set out in the second paragraph, address the Dutch Data Protection Authority (https://autoriteitpersoonsgegevens.nl) with a request for mediation or advice in their dispute with the data controller. In that case, the application as referred to in the first paragraph can still be submitted after the data subject has received notification from the Dutch Data Protection Authority that it has ceased handling the case, but no later than two months after that time.

Article 13: Communication and Marketing

1. VOLKSUNIVERSITEIT AMSTERDAM uses the collected data to facilitate communication with its students, former students, and relationships/companies, and personalize it where possible. VOLKSUNIVERSITEIT AMSTERDAM may contact its students and other relationships via email or other electronic communication means to provide information about new courses or services or to invite them to participate in a survey. This processing is necessary to serve our legitimate interests.
2. VOLKSUNIVERSITEIT AMSTERDAM sends out weekly newsletters with its latest offerings and sometimes with promotional discounts. Newsletter recipients can unsubscribe from the newsletter at any time by using the link provided at the bottom of each email.
3. VOLKSUNIVERSITEIT AMSTERDAM's website: cookies. The cookies are placed to analyze how the website and advertisements can be made as interesting and relevant as possible to the visitors. By using this website, you agree to the placement of cookies. A cookie is a small file that is sent along with the pages of this website and stored by the browser on the computer's hard drive. VOLKSUNIVERSITEIT AMSTERDAM's site uses various types of cookies.
Functional cookies are placed by default. These cookies are necessary as they ensure the proper functioning of the website. Examples of these cookies include the shopping cart and language preference.

ATTACHMENT I

The file includes the following data about the individuals mentioned in Article 3:

  • Last name, first name
  • Address, postal code*
  • Place of residence*
  • Daytime, evening, and mobile phone numbers**
  • Gender*
  • Email address
  • Date of birth*: Registration for activities of Stichting VOLKSUNIVERSITEIT AMSTERDAM is generally possible for individuals aged 18 and older.

* Data regarding place of residence, postal code, age, and gender are processed anonymously by us for statistical data on who our students are and where they come from.

** Phone and/or email data are necessary to timely inform students in case of teacher illness and other lesson changes.
